Definition
The Rajya Sabha (Council of States) is the upper chamber of Parliament under Article 80 of the Constitution of India. Article 80(1) caps membership at 250: up to 238 elected representatives of the states and union territories and 12 nominated members appointed by the President for “art, literature, science and social service”.
The present strength is 245 (233 elected + 12 nominated) following the Jammu & Kashmir Reorganisation Act, 2019 (Act 1 of 2019), which reduced the erstwhile 31 seats allotted to the former state.
Election of the 233 members follows the single‑transferable‑vote (STV) system with open ballots, as prescribed by the Representation of the People Act 1951 (amended 2003). Each MLA casts a preferential vote; the quota is ⌊(total valid votes / (seats + 1))⌋ + 1. Seats are allocated to states and union territories in proportion to their population as recorded in the latest Census (Schedule 1, amended 2000). Consequently, the party composition of a state legislature directly determines that state’s Rajya Sabha delegation, embedding federal influence into national legislation.
The President’s 12 nominees, selected under Article 80(1)(b), are not bound by any party affiliation but have historically been drawn from the ruling party’s patronage network, creating a hybrid of expertise and political leverage.
Members serve staggered six‑year terms; every two years, roughly one‑third of the elected seats (≈ 78) expire, as mandated by Article 84(2). The chamber is a permanent body—no dissolution occurs, only partial renewal.
The Vice President of India, ex‑officio Chairman per Article 64 and Article 86, presides over sessions; the Deputy Chairman, elected from among members, conducts proceedings in the Chairman’s absence.

Rajya Sabha: Composition, Election and Powers
Composition
- Article 80(1) caps the Council at 250 members: 238 elected (state/UT legislatures) + 12 nominated (President).
- The Fourth Schedule fixes each state’s entitlement; after the Jammu & Kashmir Reorganisation Act, 2019, the total seated strength is 245 (233 elected + 12 nominated).
- Nominated members are appointed under Article 80(1)(a) for “art, literature, science and social service”.
💡 Key Insight: Although the Constitution allows up to 250 members, the Rajya Sabha currently functions with 245 seats because the re‑organisation of Jammu & Kashmir reduced the elected quota.

Election Mechanism
- State legislative assemblies elect members by single transferable vote (STV) with proportional representation, as prescribed by Section 3 of the Representation of the People Act 1951.
- Union territories possessing legislatures (Delhi, Puducherry) elect members under the same STV formula; union territories without legislatures (e.g., Chandigarh) have no elected seats.
- The ballot is open; each MLA ranks candidates, and the quota is calculated by the Droop formula.
💡 Key Insight: Union territories that lack a legislature, such as Chandigarh, are excluded from electing Rajya Sabha members, underscoring the necessity of a legislative body for representation.
